HomeMy WebLinkAbout~Master - Completion of SE 16th Street Paving & Bridge Replacement RESOLUTION NO. 09-337 RESOLUTION ACCEPTING AS COMPLETE AND SATISFACTORY WORK DONE UNDER CONTRACT FOR THE SOUTHEAST 16TH STREET PAVING AND BRIDGE REPLACEMENT PROJECT; ORDERING FINAL PAYMENT, DETERMINING AMOUNT TO BE ASSESSED;AND ORDERING FINAL PLAT AND SCHEDULE WHEREAS, the City's Engineers have reported that they have inspected the work and find it in compliance with the terms of the contract for the Southeast 10h Street Paving and Bridge Replacement Project; and, WHEREAS, the City Council is now asked to accept said work and authorize payment; NOW, THEREFORE, BE IT RESOLVED, by the City Council for the City of Ames, Iowa: Section One. The work done pursuant to the contract for the Southeast 16' Street Paving and Bridge Replacement Project is hereby accepted as complete and satisfactory,and payment to Peterson Contractors, Inc. (PCI) in the amount of$3,665,368.89 is hereby authorized. Section Two. If, after the thirtieth day from the date of this acceptance no valid claims remain filed against the amounts retained and unpaid under the contract, and all other performance required of the contractor is found to be completed, the Director of Public Works shall cause the said retained amount to be paid to the contractor, as well as any other amount due the contractor. Section Three. The total cost of the said project is$4,302,122.89 not more than$1,352,000.00 of which shall be assessed to the benefitted property owners. Section Four. Within thirty days hereof the engineers shall file with the City Clerk a final assessment schedule showing: a. a description of each lot to be assessed; b. the valuation of each lot as fixed by the Council; C. the amount to be assessed against each lot,which shall include the assessment for the default fund,and the amount of deficiency,which maybe subsequently assessed against that lot under Section 384.63, Code of Iowa.
