RESOLUTION APPROVING AGREEMENT FOR
RECONSTRUCTION AND WIDENING OF BLOOMINGTON ROAD
AT-GRADE RAILROAD CROSSING
FOR THE CITY OF AMES
WHEREAS,according to the developer's agreement associated with the platting of the Uthe
Farm located north of Bloomington Road and west of the Union Pacific Railroad (UPRR), the
developer is responsible for installation of all improvements specified by the agreement; and,
WHEREAS,this includes widening a portion of Bloomington Road along the southern edge
of the development into a four-lane roadway, thereby also widening the existing at-grade railroad
crossing; and,
WHEREAS, any public access across railroad right-of-way must be done through an
agreement between the Highway Authority(City of Ames)and the rail property owner(UPRR),and
this agreement identifies all costs associated with engineering and construction to modify the
crossing corresponding to the new configuration of the roadway; and,
WHEREAS,it will also include the cost to establish a new definition of the"crossing area,"
which grants to the City the authority to use the additional UPRR right-of-way for public use; and,
WHEREAS,the total cost for engineering and construction is estimated to be$298,992,with
the cost to authorize use of the additional width for public access in the amount of$9,048 to be paid
at the time in which this agreement is executed; and,
WHEREAS, this brings the total estimated cost of the project to $308,040 to be paid to the
UPRR by the developer.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ames, Iowa,
that the agreement with the Union Pacific Railroad to widen the Bloomington Road at-grade railroad
crossing at the estimated cost of$308,040 to be paid by the developer is hereby approved.
ADOPTED THIS 27`h day of January, 2009.
