RESOLUTION APPROVING REQUEST FOR
ONE-TIME EXCEPTION FROM 5,000 CUBIC FOOT CALENDAR YEAR TOTAL
EXEMPTION ALLOWED ON SEWER CHARGES
FOR THE CITY OF AMES
WHEREAS,Roger Swenson submitted a letter to the Council requesting an exception from the
5,000 cubic foot exemption allowed on the sewer charges billed on the October 21, 2008, utility
statement for 717 Onyx Street; and,
WHEREAS,the house was vacant when the water heater drain plug broke,resulting in 121,220
cubic feet of water usage; and,
WHEREAS,as a result of this situation,Mr. Swenson was billed$2,043.05 for sanitary sewer
charges, and a portion of the water went to the sump pump and was pumped into the storm sewer
system, with the remaining water going to the floor drain and into the sanitary sewer system; and,
WHEREAS, staff believes it is reasonable to estimate that up to one-third(40,400 cubic feet)
of the water did not reach the sanitary sewer system, and under this assumption, Mr. Swenson's total
obligation would be reduced to $1,364.33; and,
WHEREAS, the sewer rate structure amended by the Council in May 2008 allows for an
exemption of up to 5,000 cubic feet of water usage in a calendar year if in any billing period more than
2,000 cubic feet of water is used in such a way that the water does not reach the sanitary sewer system;
and,
WHEREAS,Council can approve a one-time exception specifically for this request and direct
staff to adjust the sewer charges on the October 21, 2008, statement.
NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of Ames,Iowa,that
the request for a one-time exception from the 5,000 cubic foot exemption allowed on the sewer charges
billed on the October 21, 2008, utility statement for 717 Onyx Street is hereby approved, and staff is
directed to adjust the sewer charges on this statement to reflect the charges on the estimated amount of
water that reached the sanitary sewer system.
