HomeMy WebLinkAbout~Master - Fencing Agreement with Union Pacific Railroad RESOLUTION NO. 08-282 RESOLUTION APPROVING MEMORANDUM OF UNDERSTANDING WITH UNION PACIFIC RAILROAD FOR CENTRAL BUSINESS DISTRICT FENCING FOR THE CITY OF AMES WHEREAS, trespassing on railroad right-of-way is a cause for great safety concern and is an ongoing issue on the Union Pacific Railroad(UPRR)main line tracks through downtown Ames; and, WHEREAS,in an effort to discourage mid-block crossing of the tracks and improve safety, UPRR recently installed fencing from Duff Avenue through the depot area; and, WHEREAS,the fencing has been installed within the UPRR right-of-way on the north side of the tracks, and pedestrian and vehicle crossings at Duff, Kellogg, and Clark remain open; and, WHEREAS, the fencing project has remained a very important safety improvement for the City, so partnering discussions have taken place with UPRR for several months to accomplish the installation; and, WHEREAS, these discussions resulted in the finalization of a Memorandum of Understanding,whereby the UPRR is paying for the installation of the fence, and, in turn,the City is to perform routine maintenance,repair,and replacement as needed for a period of 20 years (or as long as the warranty on the fence is in effect); and, WHEREAS, the UPRR has agreed to pay for any damage that occurs due to railroad operations. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ames, Iowa, that the Memorandum of Understanding with the Union Pacific Railroad in relation to the Central Business District fencing is hereby approved.
