RESOLUTION APPROVING DEVELOPER'S AGREEMENT FOR OFF-SITE
IMPROVEMENTS RELATING TO BLOOMINGTON ROAD EXPANSION
IN NORTHRIDGE HEIGHTS SUBDIVISION, 12TH ADDITION
FOR THE CITY OF AMES
WHEREAS,a request from Uthe Development Company,LLC,has been received to approve
the Final Plat for Northridge Heights Subdivision, 12t''Addition; and,
WHEREAS,the proposed subdivision is generally located north of Bloomington Road at the
intersection with Stange Road; and,
WHEREAS,acceptance of a developer's agreement,including a Letter of Credit to guarantee
completion of required public improvements, is the typical way in which the City Council has
allowed the approval of final plats for new subdivisions where the installation of streets and other
infrastructure has not been completed prior to approval of that final plat; and,
WHEREAS, the developer has been notified by staff of this option so that an agreement
might be prepared and the associated financial security be provided to cover the estimated cost of
off-site improvements, should the Council choose to allow deferral of improvements; and,
WHEREAS, should the City Council allow deferral, staff recommends that the off-site
improvements be completed prior to the issuance of a Certificate of Occupancy for any structure
within the plat.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ames, Iowa,
that the Developer's Agreement with Uthe Development Company,LLC,for off-site improvements
relating to Bloomington Road expansion in Northridge Heights Subdivision, 12t'Addition,is hereby
approved,subj ect to a Letter of Credit being filed with the City as security for completion of said off-
site improvements.
ADOPTED THIS 24t' day of June, 2008.
