HomeMy WebLinkAbout~Master - Covenant and agreement for annexation with E Free Church RESOLUTION NO.08-249 RESOLUTION APPROVING COVENANT AND AGREEMENT FOR ANNEXATION WITH FIRST EVANGELICAL FREE CHURCH FOR THE CITY OF AMES WHEREAS, the First Evangelical Free Church is planning to build a new church on a single 75-acre parcel on the west side of George Washington Carver Avenue north of Cameron School Road;and, WHEREAS,upon completion as currently planned,the project would include buildings,parking for 541 vehicles,as well as open space containing two softball fields,two soccer fields,detention and retention ponds, prairie grasses,a trail system,and a courtyard; and, WHEREAS,the property is located within the Ames Urban Fringe in an area that the Ames Urban Fringe Plan designates as Rural Transitional Residential(RTR)—one ofthe designations in the Rural Urban Transitional Area(RUTA)land use classes; and, WHEREAS,the church is preparing to build the first phase of this project,and Story County has issued a Conditional Use Permit for this phase,with the following condition:Prior to issuance of any Zoning Permit, the applicant shall work with the City of Ames in securing appropriate Annexation Agreements, and in the instance where the City ofAmes would not require such an Annexation Agreement, the applicant shall provide document from the City of Ames stating such; and, WHEREAS,RUTA policies indicate that annexation agreements and other tools maybe utilized to ensure new development is prepared for potential annexation in the future, and are required in instances of new development that is intense or that occur in certain critical locations; and, WHEREAS,this annexation agreement provides that at any time the property becomes contiguous to the city,Ames may notify the property owner that it is considering annexation,and the owner agrees to then file a request for annexation; and, WHEREAS,the owner also agrees to waive its right to withdraw this request or its consent to annexation; and, WHEREAS,the agreement runs with the property for 21 years,and the City may seek extension of the agreement beyond that time period. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ames, Iowa, that the Covenant and Agreement for Annexation with the First Evangelical Free Church of Ames for property located on George Washington Carver Avenue at Cameron School Road is hereby approved.
