HomeMy WebLinkAbout~Master - Waiver of subdivision requirements for property on 550th Avenue RESOLUTION NO.07-487 RESOLUTION APPROVING WAIVER OF SUBDIVISION REQUIREMENTS FOR PROPERTY LOCATED ON 550TH AVENUE IN STORY COUNTY FOR THE CITY OF AMES WHEREAS,the City received a request for approval of a proposed subdivision located directly west of 550`h Avenue, east of U.S. Highway 69, south of Ken Maril Road, and north of 265`h Street, and this property is located outside the City's corporate limits; and, WHEREAS, the request was initially presented to Council on September 12, 2006, however, at that meeting, the Council moved to postpone this case file until the meeting of September 26,2006,in order to afford staff the time to discuss the covenants with the property owners; and, WHEREAS, staff did discuss the covenants with the property owners and their representatives, however, Mr. Musselman, one-third owner of the property, did not wish to sign the covenants and the case file was closed due to lack of activity; and, WHEREAS,the new application—while the same proposal—provides additional clarification of the circumstances surrounding the subdivision; and, WHEREAS,the proposed subdivision involves land owned by Crystalwood Estates, LLC, and Robert Musselman, and is a vacant property approximately 34.45 acres in size; and, WHEREAS, no public improvements or infrastructure are proposed, and the applicant proposes to subdivide the property into two parcels,Parcel"M"and Parcel"N"; and, WHEREAS,the owner's representative has requested that the City waive its subdivision authority rather than apply for approval of a Major Subdivision; and, WHEREAS,Story County has conducted a L.E.S.A.evaluation on the subject property and determined that it is high value agricultural land,which requires a minimum of 35 acres to be allowed to construct a home on this property, and prior to subdividing,the property is approximately 34.45 acres in size; and, WHEREAS, Story County staff has further identified that due to the high L.E.S.A. score and the restrictive lot size, it would hard for the property owner to further develop the property for residential use; and, WHEREAS,normally,staff would recommend a waiver ofthe subdivision authority upon return of covenants for rural water and waiver of objections to future assessments,however,for reasons associated with the zoning,location,and use of this property,the requirement of covenants is not necessitated; and, WHEREAS,staff recommends that the waiver be approved with the stipulation that the platting requirements of Story County need to be met and a copy of the recorded Plat of Survey be delivered to the City Clerk for our records. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ames, Iowa, that the waiver of subdivision requirements for the proposed two-lot subdivision on 550`h Avenue in Story County is hereby approved, subject to the above-mentioned stipulation.
