HomeMy WebLinkAbout~Master - Land lease for Aquatic Center RESOLUTION NO. 07-404 RESOLUTION APPROVING LAND LEASE FOR AQUATIC CENTER SITE FOR THE CITY OF AMES WHEREAS,prior to proceeding with a bond referendum regarding the new outdoor aquatic center site, staff received assurance from the Iowa State University(ISU) administration that it would support a long-term lease of its property on 13`' Street as a site for this new facility; and, WHEREAS, as has been the case in many other cooperative arrangements between the City and ISU,staff has developed a draft agreement for approval from the Board of Regents and the City Council, and the proposed agreement was submitted to the Council on July 10,2007,for review and comment;and, WHEREAS, rather than approve the contract that the administrative staff had developed, the Board of Regents granted authority to the executive director of the Board of Regents and ISU administrators to negotiate a satisfactory lease agreement with the City; and, WHEREAS, inherent in this direction was the requirement that three legal entities be involved in the negotiations and must approve of all of the terms included in our lease agreement, and for the first time, staff was asked to satisfy the desires of the attorneys from ISU, Board of Regents Office, and the Attorney General's Office; and, WHEREAS, it became obvious from initial discussions that the legal advisors were determined to treat this transaction with the City as they would with any other entity with whom they would lease their property; and, WHEREAS,this approach proved to be frustrating since the City and ISU have a rich history of cooperative arrangements that were based on mutual trust and an understanding that our special relationship justified us being treated uniquely,therefore, the lease document has significantly changed from the one that was reviewed by Council on July 10. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ames, Iowa, that the lease agreement for the aquatic center site on 13t1i Street between the City of Ames and Iowa State University is hereby approved.
