RESOLUTION APPROVING DEFERRAL OF SIDEWALKS FOR
108 JEWEL DRIVE
FOR THE CITY OF AMES
WHEREAS, the developer of commercial property at 108 Jewel Drive is requesting that the
Council defer the installation of sidewalk in the right-of-way along South Duff Avenue; and,
WHEREAS, a commercial development is proposed at this location, which will include the
construction of a 23-unit apartment building, off-street, parking, extension of public utilities, and
perimeter parking lot landscaping; and,
WHEREAS, the installation of public sidewalk is one of the public infrastructure
improvements required to approve the Minor Site Development Plan, and the public sidewalk along
Jewel Drive will be constructed as part of this project,however,it is proposed that the sidewalk along
South Duff Avenue be constructed later; and,
WHEREAS,the developer has been asked to provide a cash escrow in the amount of$3,128
to cover the estimated cost of installing the South Duff sidewalk; and,
WHEREAS, construction of sidewalk in the South Duff Avenue right-of-way is subject to
approval by the Iowa Department of Transportation, and representative of the IDOT have indicated
that sidewalk installation along the South Duff portion will not be approved until after an intersection
design has been completed in conjunction with the future widening project; and,
WHEREAS, the applicant has agreed to sign a deferment agreement prior to the Council's
approval of this request.
NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of Ames,Iowa, that
the Agreement for Deferment of Sidewalk Installation along South Duff Avenue at 108 Jewel Drive
is hereby approved, subject to the developer signing the Agreement prior to the October 24, 2006,
Council meeting and the filing of the cash escrow to cover the estimated cost of the sidewalk
installation.
ADOPTED THIS 24th day of October, 2006.
