HomeMy WebLinkAbout~Master - Waiver of subdivision requirements for 27922 Timber Road RESOLUTION NO. 06-157 RESOLUTION APPROVING REQUEST FOR WAIVER OF SUBDIVISION REQUIREMENTS FOR 27922 TIMBER ROAD FOR THE CITY OF AMES,IOWA WHEREAS, on January 6, 2006, a pre-application conference was held by the City's Development Review Committee (DRC) concerning a proposed subdivision located at 27922 Timber Road; and, WHEREAS,this property is located south of the corporate limits of Ames near the edge of the two- mile extraterritorial boundary; and, WHEREAS,the proposed subdivision involves land owned by the estate of Rachel Lowman,and the proposal involves the shifting of existing lot lines necessary to settle the estate; and, WHEREAS,no public improvements or infrastructure is proposed,and City staff has determined that since the property does not contain public infrastructure, a Major Subdivision would be required; and, WHEREAS,the owner is requesting that the City waive its subdivision authority rather than apply for approval of a Major Subdivision; and, WHEREAS,the property is located to the south of the City in Story County approximately two miles east of Kelley,which is well outside the current corporate limits and not located within the"Priority Growth Area"of Ames; and, WHEREAS, the proposed subdivision does not create any new lots and no public infrastructure is proposed, and the subdivision is proposed solely to settle an estate; and, WHEREAS,given that its location is at the far southern edge of the City's two-mile jurisdiction area, annexation to the City of Ames is highly unlikely for the foreseeable future; and, WHEREAS, because of its location, staff does not support enactment of a covenant requiring "no protest" of future City assessments for infrastructure. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ames, Iowa,that the request for waiver of subdivision requirements for property located at 27922 Timber Road is hereby approved.
