RESOLUTION APPROVING WORKER'S COMPENSATION SETTLEMENT
FOR THE CITY OF AMES
WHEREAS, one of the City's Electric Services Lineworkers has been off of work due to a
work-related injury for over a year; and,
WHEREAS, Brian Opstvedt has worked for the City since 1985; and,
WHEREAS,medical practitioners have determined that Mr. Opstvedt is unable to return to
work and perform the duties of his previous position as a Line Foreman, and he has applied for
disability; and,
WHEREAS, state law requires that the employee (or former employee) and the employer
enter into a mediation process to determine the amount of the settlement of the Worker's
Compensation claim; and,
WHEREAS,as a result of the mediation process,the City Risk Manager and the City's legal
representative have determined that an amount of$173,000 is a reasonable settlement for the claim
and a release of all current and future claims related to this matter; and,
WHEREAS, staff is recommending approval of this payment to Mr. Opstvedt in
consideration of a full release of all claims and dismissal of the case.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ames, Iowa,
that the Worker's Compensation settlement with Brian Opstvedt in the amount of $173,000 in
exchange for a full release of all claims and dismissal of the case is hereby approved.
ADOPTED THIS 28th day of June, 2005.
