HomeMy WebLinkAbout~Master - Revision of Bandshell Improvements Funding Agreement RESOLUTION NO. 05-098 RESOLUTION APPROVING REVISION OF BANDSHELL IMPROVEMENTS FUNDING AGREEMENT WITH THE AMES FOUNDATION FOR THE CITY OF AMES WHEREAS,in December 2004,the Council approved a Bandshell Improvement Funding Agreement with the Ames Foundation,and this agreement calls for the Foundation to transfer$228,000 to the City;and, WHEREAS,these private funds will be added to$100,000 in City of Ames Local Option Sales Tax funding; and, WHEREAS, Architects, Rudi, Lee, Dreyer have been retained at a cost not to exceed $15,000 to administer and review bid documents and for construction administration services once the bid is awarded; and, WHEREAS, three bids were received, and the low bid is $14,000 over the estimated cost for this construction; and, WHEREAS, staff met with members of the Ames Foundation to review the bids and to establish a course of action, and members of the Ames Foundation and the City want to have a contingency fund of approximately 10%available to the City in the event change orders are required; and, WHEREAS,to that end,the Ames Foundation is recommending that the existing written agreement be revised; and, WHEREAS,the Foundation originally approved transferring$228,000 to the City,however,now it wants to transfer an additional $9,300 so that the project budget can include a full 10% contingency of $29,300; and, WHEREAS, if total costs exceed $337,300, the Foundation will pay that difference to the City, however, if total costs are less than that amount,the difference will be returned to the Foundation. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ames, Iowa, that the amendment to the Bandshell Improvement Funding Agreement with the Ames Foundation is hereby approved.
