HomeMy WebLinkAbout~Master - Agreement for West Towne Apartments Traffic Impact RESOLUTION NO. 05-040 RESOLUTION APPROVING AGREEMENT PERTAINING TO TRAFFIC IMPACT OF WEST TOWNE APARTMENTS ON MORTENSEN ROAD FOR THE CITY OF AMES WHEREAS, Section 29.1502 of the Municipal Code provides the City with the authority to require a traffic impact study prior to approval of a site plan for development; and, WHEREAS, a traffic study was submitted for the mixed-use development (West Towne Apartments) currently under construction at 4720 Mortensen Road; and, WHEREAS,the results of said study concluded that the proposed uses would generate more traffic than originally contemplated for this site; and, WHEREAS, it was determined that limiting the amount of commercial space occupied by retail uses to 25%of the total commercial space on the site would keep the traffic generation in line with the original estimates of the previous traffic study; and, WHEREAS, an Agreement has been prepared and signed by the developers, Premier Contractors, Inc., that addresses action to be taken if retail uses of the site exceed 25% of the commercial uses on the entire site and/or traffic levels and congestion is increased at the intersection of South Dakota Avenue and Mortensen Road. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ames, Iowa, that the Agreement Pertaining to Traffic Impact between the City of Ames and Premier Contractors, Inc., is hereby approved.
