HomeMy WebLinkAbout~Master - Waiver of subdivision requirements, Boone County RESOLUTION NO. 04-167 RESOLUTION APPROVING WAIVER OF REQUIREMENT FOR APPROVAL OF A SUBDIVISION PLAT BY THE CITY OF AMES FOR PROPERTY DESCRIBED AS PARCEL "A"IN THE SW 1/4 OF SECTION 25, JACKSON TOWNSHIP,IN BOONE COUNTY WHEREAS, on April 7,2004,the City received a request to waive the requirement for approval of a subdivision by the City of Ames; and, WHEREAS, the proposed subdivision is located inside the two-mile jurisdiction of Ames in the Southeast 1/4 of the Southwest 1/4 of Section 25,Jackson Township, in Boone County; and, WHEREAS,the subject property includes a total of 7.62 acres and the property owners propose to divide the land into two parcels; and, WHEREAS, the applicant is requesting that the City of Ames defer the subdivision review and approval authority for this proposed division of land to the Boone County Supervisors; and, WHEREAS, Chapter 23 of the Municipal Code includes provisions for the subdivision of land in Ames and within two miles of the corporate limits; and, WHEREAS,the subject property is located to the west of the City in Boone County,well outside the current City of Ames corporate limits, and is not located within the "Priority Growth Area"of the City of Ames. NOW, THEREFORE,BE IT RESOLVED by the City Council of the City of Ames, Iowa, that the requirement for approval of a subdivision plat by the City of Ames is hereby waived for approximately 7.62 acres of land described as Parcel"A"in the SW 1/4 of Section 25,Jackson Township,in Boone County,with the following stipulation: 1. That a Plat of Survey be filed with Boone County,which divides the land as proposed into Parcels"E"and"F."A legal description for Parcel"E"and for Parcel"F"must be included on the Plat of Survey. ADOPTED THIS 27th day of April,2004.
