RESOLUTION APPROVING REQUEST FOR WAIVER
OF SIDEWALK REQUIREMENT FOR PROPERTY LOCATED
AT 1401 NORTH DAKOTA AVENUE
FOR THE CITY OF AMES
WHEREAS,the property owner is currently constructing a multi-family building at 1401 North
Dakota Avenue; and,
WHEREAS, the site was originally platted as three lots and was developed with a single-story
building utilized as a childcare facility; and,
WHEREAS, as a requirement of redevelopment of the site, the property owner replatted the
existing three lots into one lot; and,
WHEREAS, as required by the Subdivision Ordinance, the property owner was required to
construct sidewalks adjacent to the subject site within the right-of-way along North Dakota Avenue,
Toronto Street, and Hutchinson Street; and,
WHEREAS,as required by the Subdivision Ordinance and established policy,the property owner
submitted a signed sidewalk agreement ensuring construction of the sidewalks within two years; and,
WHEREAS,the property owner is requesting waiver of the requirement to install sidewalks along
Toronto Street and Hutchinson Street,but is willing to install sidewalks along North Dakota Avenue;and,
WHEREAS, staff does not believe there is substantial justification to waive or defer the
requirement to install a sidewalk along Hutchinson Street; however, they do believe that there is
justification to deter the requirement to install a sidewalk along Toronto Street.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ames, Iowa, that
the determent of the installation of the sidewalk along Toronto Street only is approved until such time as
the City Council determines that sidewalks are needed.
