HomeMy WebLinkAbout~Master - HIPAA Policies and privacy officer RESOLUTION NO. 04-119 RESOLUTION ADOPTING HEALTH INSURANCE PORTABILITY AND ACCOUNTABILITY ACT (HIPAA) OF 1996 POLICIES AND APPOINTMENT OF PRIVACY OFFICER FOR THE CITY OF AMES WHEREAS, the HIPAA (Act) of 1996 was an attempt to reform a number of problems that had emerged in the U. S. Health care system; and, WHEREAS, the initial Act provided that within three years of the passing of the legislation, Congress would also enact legislation protecting the privacy of individually identifiable health information or protected health information; and, WHEREAS, Congress failed to do this, and therefore, the responsibility fell on the Department of Health and Human Services; and, WHEREAS,final regulations appeared in the Federal Register on August 12,2002,and are known as the Privacy Rule; and, WHEREAS,as a fully self-funding employer that has access to and receives PHI(protected health information) as part of its role as the health care plan administrator, the City must comply with the regulations. WHEREAS, in order to accomplish this, the City of Ames must: 1. Appoint a Privacy Official who will have the responsibility for the development and implementation of the privacy policies and procedures. 2. Designate a contact person and/or office for privacy-related issues, questions, and complaints. 3. Provide a Notice of Privacy Practices to all plan participates. 4. Adopt HIPAA Privacy Act Policies and Procedures. NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of Ames,Iowa, that the above-listed HIPAA Privacy Act Policies and Procedures, as attached hereto, are hereby approved.
