RESOLUTION APPROVING REQUEST FOR TIME EXTENSION TO
THE DEVELOPER'S AGREEMENT FOR THE REDEVELOPMENT OF
CITY-OWNED PROPERTY AT 623 NINTH STREET
FOR THE CITY OF AMES
WHEREAS, at its July 22,2003,meeting,the City Council approved the agreement for the
redevelopment and sale of City-owned property at 623 Ninth Street with Amellen Construction and
Sales, Inc.; and,
WHEREAS, some remaining conditions of the developer's agreement still need to be met,
and one such issue is that construction of the home was to be completed on or before November 28,
2003; and,
WHEREAS, Amellen Construction and Sales, Inc., is requesting an amendment to the
developer's agreement for a time extension to complete the home construction until December 31,
2003; and,
WHEREAS, Amellen Construction and Sales, Inc., is further requesting: a Certificate of
Occupancy on the completion of the first floor when it meets the occupancy requirements of the
Building Code; and, to escrow funds for the completion of the landscaping and sidewalks (due to
weather constraints)until April 30, 2004; and,
WHEREAS, staff has reviewed the developer's requests and is recommending approval of
the requests with the following stipulation:that a deposit of$7,500 be provided to the City and held
as escrow until April 30,2004,by which time the landscaping and sidewalk work is to be completed
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ames, Iowa,
that the aforementioned amendments to the developer's agreement between the City of Ames and
Amellen Construction and Sales,Inc.,for the redevelopment ofproperty located at 623 Ninth Street
are hereby approved as stipulated.
