HomeMy WebLinkAbout~Master - Waiver of subdivision requirements for 26722 U.S. Highway 69 RESOLUTION NO.03-297 RESOLUTION APPROVING WAIVER OF MAJOR SUBDIVISION REQUIREMENTS FOR PROPERTY LOCATED AT 26772 U. S.HIGHWAY 69 FOR THE CITY OF AMES WHEREAS, Anthony and Michelle Hofbauer have requested a waiver of infrastructure requirements for a proposed two-lot subdivision located approximately one and one-quarter miles south of the corporate limits of Ames(in the southwest quarter of Section 26,Township 83 North,Range 24 West of the 5"'P.M., Story County,Iowa);and, WHEREAS, this property, consisting of approximately 6.00 acres, is outside the City's corporate limits,but within its two-mile jurisdiction; and, WHEREAS,pursuant to Section 23.103(1)of the Municipal Code,the City Council may modify or waive the requirements of the subdivision regulations. NOW, THEREFORE,BE IT RESOLVED by the City Council of the City of Ames,Iowa, that the waiver of major subdivision requirements for the property located at 26772 U. S. Highway 69 is hereby granted subject to the following stipulations: 1. That the property owners waive their rights to object to future assessments for public improvements, including,but not limited to,street paving,bicycle paths,sidewalks,and utility improvements.The City Attorney will prepare an agreement to be signed by the property owners, entitled, "Covenant for Assessment of Costs of Improvements." 2. That the property owners agree to pay any and all costs related to disconnection of the rural water facilities at the time land in this subdivision is annexed into the City of Ames. The City Attorney will prepare an agreement to be signed by the property owners, entitled, "Covenant Pertaining to Water Service." 3. That the property owners have a legal document prepared to establish a cross-easement to provide access across Lot 1 for Lot 2. 4. Once the property owners provide one copy,with original signatures,of the"Covenant for Assessment of Costs of Improvements"and the"Covenant Pertaining to Water Service,"as well as one copy of the recorded cross-easement and Plat of Survey, City staff will waive the requirement for the platting of a Minor Subdivision and will record both Covenants. All recording fees are the responsibility of the property owners.
