HomeMy WebLinkAbout~Master - Waiver of subdivision requirements within the City's two-mile jurisdiction RESOLUTION NO. 03-226 RESOLUTION APPROVING WAIVER OF REQUIREMENT OF SUBDIVISION APPROVAL FOR TWO-LOT SUBDIVISION LOCATED WEST OF TIMBER ROAD, EAST OF 530TH AVENUE, AND NORTH OF 280TH STREET IN STORY COUNTY WHEREAS, the proposed subdivision is located approximately 1 1/4 miles south of the City's corporate limits, but within the City's two-mile jurisdiction area; and, WHEREAS, more specifically, the site is located approximately one-half mile west of Timber Road, one-half mile east of 530`'Avenue and one-half mile north of 280th Street; and, WHEREAS,the property owner is requesting a waiver to the requirement for the installation of public infrastructure for a two-lot land division for the purpose of constructing a single-family dwelling on each lot; and, WHEREAS, under Iowa Code Section 354.9(2),the City may waive its right to review the subdivision or waive the requirements of any of its standards or conditions for approval of subdivisions and certify the resolution which shall be recorded with the plat; and, WHEREAS,the proposed two-lot subdivision is located outside the Targeted Growth Area of the City of Ames. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ames, Iowa, that a waiver of the requirement for approval of a two-lot subdivision plat located in Story County approximately 1 1/4 miles south of the City's corporate limits is hereby approved.
