HomeMy WebLinkAbout~Master - Waiver of encroachment permit fee at Evert's Flowers & Gifts RESOLUTION NO. 03-201 RESOLUTION APPROVING WAIVER OF FEE FOR ENCROACHMENT PERMIT AT EVERT'S FLOWERS & GIFTS FOR THE CITY OF AMES WHEREAS, one of the 2001/02 "Art Around the Corner"sculptures has been sold to a local business; and, WHEREAS, Evert's Flowers&Gifts purchased"Kristin's Flowers,"which is installed on the concrete pad adjacent(Pad#7)to its store at 329 Main Street; and, WHEREAS, before making the decision to purchase the artwork, Brian and Gina Smith, owner's of Evert's, asked for permission to keep the artwork at this location; and, WHEREAS,even though this is one of the pads for the annual"Art Around the Corner"revolving artwork exhibition,there are 17 pads available and only six to eight sculptures are selected each year for exhibition;and, WHEREAS,the Public Art Commission is amenable to allowing this purchased artwork to remain at its location; and, WHEREAS,to make this possible, it is necessary for Evert's to apply for and receive an Encroachment Permit; and, WHEREAS, since continued display of this sculpture will augment the City's"Art Around the Corner" exhibition, it would seem appropriate to waive the standard permit fee of$25.00; and, WHEREAS, terms of the Encroachment Permit Agreement stipulate that: 1) Evert's will maintain the sculpture,will provide a Certificate of Insurance, and will have the right to remove the sculpture at any time;2) the City will maintain the concrete pad and will have the right to remove the sculpture for any reason;and,3)the City and Public Art Commission will make arrangements to have a new plaque made to match the other"Art Around the Corner"plaques,but it will identify Evert's as the owner. NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of Ames,Iowa,the waiver of the Encroachment Permit fee is hereby approved and will allow"Kristin's Flowers"to remain on Pad#7 under the terms and conditions stipulated in the Agreement.
