HomeMy WebLinkAbout~Master - Waiver of subdivision regulations for 3513 - 3603 547th Avenue RESOLUTION NO. 03-057 RESOLUTION APPROVING REQUEST FOR WAIVER OF SUBDIVISION REGULATIONS FOR PROPERTIES LOCATED AT 3513-AND 3603-547TH AVENUE FOR THE CITY OF AMES WHEREAS, on January 14, 2003, the Council referred to staff a request to waive infrastructure requirements for a proposed two-lot subdivision located at 3513-and 3603-547th Avenue,which is outside the City's corporate limits,but within its two-mile jurisdiction; and, WHEREAS,to meet the City's requirements,the property owner is required to install sanitary sewer and water infrastructure to City standards; and, WHEREAS, staff believes it is reasonable to allow septic systems and rural water service in this proposed subdivision without the requirement for the installation of dry pipes for future connections to municipal sanitary sewer and water services for the following reasons: 1)the proposed subdivision is located outside the projected growth area for the City of Ames to the year 2030; 2) the size of proposed lots is adequate to accommodate individual septic systems;3)municipal utility services are located three-quarters of a mile or further from the proposed subdivision; and, 4)the City has no plans to extend utility services to this area at any time in the near future; and, WHEREAS, if the Council grants a waiver from the requirement to install infrastructure to City standards, staff believes the waiver should be conditioned upon the following stipulations: 1)the property owners waive their rights to object to future assessments for public improvements,including but not limited to, street paving,bicycle paths, sidewalks,and utility improvements prior to consideration of the Final Plat by the City Council;2)the property owners agree to pay any and all costs related to the disconnection of the rural water facilities at the time land in this subdivision is annexed into the City of Ames prior to consideration of the Final Plat by the City Council; and, 3) the property owners are required to dedicate public road right-of-way for 547t1i Avenue to Story County at the time of approval of the Final Plat for this subdivision. NOW, THEREFORE,BE IT RESOLVED by the City Council of the City of Ames,Iowa, that the request for a waiver of infrastructure requirements for property located at 3513 and 3603 547th Avenue is hereby approved subject to the stipulations as listed above.
