HomeMy WebLinkAbout~Master - Sale of ACCESS Building RESOLUTION NO. 03-038 RESOLUTION APPROVING SALE OF ACCESS SHELTER FACILITY AND DISTRIBUTION OF PROCEEDS OF THE SALE FOR THE CITY OF AMES WHEREAS,on January 9,2003,the Council received a request from the executive director of ACCESS for it to approve the sale of the current shelter and to allow ACCESS to retain all of the proceeds from the sale; and, WHEREAS,City staff members met with ACCESS representatives on the issues of the sale ofthe current shelter and the distribution of proceeds from any sale; and, WHEREAS, in 1984, the City and the Story County Sexual Assault Care Center entered into an agreement for the purchase of shelter property,and the City provided block grant funds in the amount of$80,000 for the purchase of the facility and some renovation costs; and, WHEREAS, in exchange for these funds,the Center Board agreed that the building could not be sold without the City's permission and that the City would approve the disbursement of the total proceeds of any sale; and, WHEREAS, it is staffs recommendation that the Council allow the sale of the current shelter and that the City receive the proceeds of the sale; and, WHEREAS,it is further staffs recommendation that the City return to ACCESS any proceeds from the sale that are over and above the City's initial$80,000 investment. NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of Ames,Iowa,to approve the sale of the current shelter facility, give all the proceeds of the sale to ACCESS, and retain a lien against the new property in the amount of$80,000,with the stipulation that a ten-year operational plan be presented to the City of Ames and the $80,000 be directly applied to the mortgage balance of the new building. BE IT FURTHER RESOLVED by the City Council that the lien include the same provisions that were included in the 1984 agreement with the City. ADOPTED THIS 28ffi day of January,2003. C:�"w.
