RESOLUTION APPROVING REQUEST
FOR WAIVER OF ENCROACHMENT FEE
FOR THE CITY OF AMES
WHEREAS, the owner of the property located at 309 South Duff Avenue is requesting
approval of an application for an encroachment permit to allow the use of 13 parking spaces on City-
owned property adjacent to that property; and,
WHEREAS,the owner of the proposed business,Panera Bread Bakery/Cafe, desires to use
the parking spaces along South Duff Avenue (on City-owned property) for the customers of his
restaurant;
WHEREAS, the fee for the encroachment is $1/square foot of land area included in the
encroachment, which would total $3,294;
WHEREAS, the applicant is requesting that the City waive the fee for the encroachment
permit; and,
WHEREAS,to implement the planned entry features of the Sub-Area Plan recently approved
by the City Council for the South Lincoln Neighborhood(at South Duff and South 3rd Street), it is
necessary for the City to obtain an easement at 309 South Duff for installation of the improvements.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ames, Iowa,
that the waiver of the encroachment fee for 13 parking spaces on City-owned property adjacent to
the east property line of 309 South Duff Avenue is hereby approved with the following condition:
The property owner must grant to the City of Ames an easement for permanent
improvements consistent with the City's plans for the South Lincoln Neighborhood,
including,but not limited to, structures,paving, plantings, lighting, and signage.
