RESOLUTION APPROVING REQUESTS FOR RURAL WATER SERVICE
FOR PROPERTIES LOCATED WITHIN
THE CITY'S TWO-MILE JURISDICTION
FOR THE CITY OF AMES
WHEREAS, in Iowa,cities retain the right to designate whether they will provide water service within
two miles of their corporate boundaries; and,
WHEREAS, if a request for water service is received,the City must designate whether they will serve
the requesting parties or allow rural water systems to provide service; and,
WHEREAS, if the City indicates that they will provide the service, it must be constructed within four
years; and,
WHEREAS,the City and Xenia Rural Water System established water service territories around the City;
and,
WHEREAS, at the time of the designation of which entity would provide service, it was known that it
would be necessary to modify the designation on a case-by-case basis for those properties on the"edges"; and,
WHEREAS, over the past several months, Xenia Rural Water System has been constructing water
facilities in the area to meet their designated customers' demands, and as a result of its work, it has received
requests from five property owners to provide them with rural water; and,
WHEREAS, the five properties are in the area that the City had previously retained for water service
(Riley property,Kingsbury property,Belz property,McCay properties,and Reyes property); and,
WHEREAS, the McCay request for rural water involves two properties in the Land Use Policy Plan
(LUPP)Growth Area B,and it is expected to be in excess of 15 years before sanitary sewer is available in the area
and development takes place; and,
WHEREAS, because of this timing, it is appropriate to give permission to Xenia to serve these two
properties; however, since the land is in the growth area, an agreement should be signed that requires the
landowner to pay any and all costs related to disconnection of the rural water facilities when the land is annexed
into the City.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ames, Iowa, that the
requests for rural water service for Riley,Belz,and Kingsbury are hereby approved;the McCay request is hereby
approved subject to signing an agreement to pay any and all costs related to disconnecting from rural water when
the land is annexed to the City; and,the Reyes request for rural water service is hereby denied.
ADOPTED THIS 23rd day of July,2002.
