HomeMy WebLinkAbout~Master - Establish Public Housing Agency (PHA) Governing Board RESOLUTION NO. 02-374 RESOLUTION TO ESTABLISH A PUBLIC HOUSING AGENCY (PHA) GOVERNING BOARD WHEREAS,Section 505 of the Quality Housing and Work Responsibility Act of 1998,and the Regulations of the Department of Housing and Urban Development promulgated at 24 CFR 964.405(b)requires that the governing body of a public housing agency(PHA)must contain not less than one member who is directly assisted by the PHA; and WHEREAS, the federal law and regulations make no exception from that requirement for cities where the housing authority governing body is the City Council; and WHEREAS,it is necessary to make arrangements to meet the requirement for appointment of at least one recipient of assistance to the PHA governing board to continue the receipt of such assistance for citizens of this City; and, WHEREAS,Section 403A.5 Code of Iowa provides that an Iowa municipality may exercise its housing powers "... through such officers of the municipality as the local governing body may by resolution determine"; NOW, THEREFORE, BE IT RESOLVED by the City Council for the City of Ames, Iowa; Section One. The governing board of the PHA for purposes of the requirements of the above stated federal law and regulations shall be the Mayor and members of the City Council of the City of Ames, Iowa plus one additional person appointed by the Mayor and confirmed by the City Council who is directly assisted by the PHA and is a member of the PHA Resident Advisory Board. Section Two. All actions of the said PHA governing board shall be done by a vote of a majority of a quorum of the board. A quorum shall be a majority of the members of the PHA governing board. The Mayor shall not vote as a member of the PHA governing board except to break a tie. The PHA governing board shall not act if the position of the member appointed as a person directly assisted by the PHA is vacant. A vacancy in the position for the directly assisted person shall be filled by appointment of the Mayor with confirmation by the City Council. Section Three. The powers of the said PHA governing board shall be no more and no less than that necessary to take the actions required of the PHA governing board under federal laws and regulations pertaining to federally assisted housing projects and programs.
