HomeMy WebLinkAbout~Master - Development agreement for South Gateway Subdivision RESOLUTION NO. 02-364 RESOLUTION APPROVING DEVELOPMENT AGREEMENT BETWEEN SOUTH DAYTON DEVELOPMENT, L.L.C.,AND THE CITY OF AMES RELATIVE TO THE SOUTH GATEWAY SUBDIVISION WHEREAS,the South Gateway Subdivision includes construction of public improvements to the infrastructure; and, WHEREAS, when the Planning and Zoning Commission and City Council took action on the Preliminary Plat for the South Gateway Subdivision, a stipulation of that approval was that the developer and City enter into a Development Agreement to address those public improvements;and, WHEREAS,the most significant issue included in the Development Agreement for the South Gateway Subdivision is the future construction of relocated South Dayton Avenue; and, WHEREAS, the Development Agreement allows for the remainder of relocated South Dayton Avenue to be installed and possibly financed through a special assessment program by the City and ultimately paid for by the developer; and WHEREAS,the Development Agreement also addresses access restrictions to each lot,water main and sanitary sewer tapping fees,and easements for sidewalks,bike paths,sanitary sewer,storm sewer, and water mains. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ames, Iowa, that the Development Agreement between South Dayton Development,L.L.C.,and the City ofAmes relative to the South Gateway Subdivision is hereby approved.
