RESOLUTION FINALLY APPROVING PLANS,
SPECIFICATIONS AND FORM OF CONTRACT
AND AWARDING A CONTRACT FOR THE CONSTRUCTION OF
2002/03 ASPHALT RESURFACING PROGRAM AND 2002/03 SEAL COAT
RECONSTRUCTION PROGRAM
FOR THE CITY OF AMES,IOWA
WHEREAS,the City Council ofthe City of Ames,Iowa,has heretofore approved plans,specifications,and
form of contract for the construction of the 2002/03 Asphalt Resurfacing Program and 2002/03 Seal Coat
Reconstruction Program as described in Resolution No. 02-214 adopted on the 9'day of April,2002; and,
WHEREAS, a hearing has been held on objections to the proposed plans, specifications, and form of
contract,and to the cost of the proposed improvement in said City,and all objections thereto have been overruled.
NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of Ames,Iowa,that the plans,
specifications,and form of contract referred to in the preamble hereof be and the same are hereby finally approved,
and the prior action of the Council approving them is hereby finally confirmed; and,
WHEREAS,the Council did publish a Notice to Bidders for the construction of said work; and,
WHEREAS,all bids have been received and considered for the above-mentioned programs;additionally
Division III, 2002/03 Park Road/Parking Lot Improvements Program, is a portion of this contract, but was not
noticed for bid because the amount is under$50,000.
BE IT FURTHER RESOLVED by the City Council of the City of Ames,Iowa,as follows:
Section 1. It is hereby found and determined that the bid of Manatt's,Inc.,of Ames,Iowa,in the amount
of$595,328.65 is the lowest and best bid for said work,and the same is hereby accepted.
Section 2. The Mayor and Clerk are hereby authorized and directed to execute a contract with the said
company in accordance with the company's proposal and the Notice to Bidders, and in accordance with
the plans and specifications heretofore adopted and approved.
Section 3. All bids or proposals received are hereby directed to be filed.
Section 4. All other bids,other than that accepted,are hereby rejected,and the Clerk is hereby authorized
and directed to return certified checks accompanying such unsuccessful bids and take receipts therefore
to be filed in the Clerk's office.
Section 5. All resolutions or orders or parts thereof in conflict herewith are hereby repealed to the extent
of such conflict.
