RESOLUTION APPROVING WAIVER OF
INFRASTRUCTURE REQUIREMENTS FOR A
40-ACRE TRACT OF LAND LOCATED AT 26114-520TH
WITHIN THE TWO-MILE JURISDICTIONAL AREA OF THE
CITY OF AMES
WHEREAS,on February 26,2002,the City Council referred to staff a request by the owners
of two tracts of land(26796 and 26114- 520t'Avenue) located within the two-mile jurisdiction of
Ames to waive the requirement for subdivision plats and to defer to the review and approval process
of Story County for the subdivision and platting of this land; and
WHEREAS, the owners of the subject properties wish to subdivision two 40-acre tracts of
land located adjacent to 520t'Avenue south of Ames in Story County; and,
WHEREAS, the subject sites are located to the south of the City, well outside the current
City of Ames corporate limits and not within the Targeted Growth Area of the City; and,
WHEREAS,City staff is working with the staffs from Boone and Story County on an urban
fringe area agreement that would outline the jurisdictional responsibilities of the Counties and the
City with regard to subdivision review, and the subject site is located in an area that is identified by
the draft agreement as an area of sole review responsibility by Story County.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ames, Iowa,
that the requirement for approval of a subdivision plat by the City of Ames for a 40-acre tract of land
located at 26796-520th Avenue and a 40-acre tract of land located at 26114-520th Avenue (within
the two-mile jurisdiction, but outside the City of Ames corporate limits on 210t'Avenue in Story
County) is hereby
ADOPTED THIS 9t'day of April, 2002.
