HomeMy WebLinkAbout~Master - Dividing special assessment for alley paving in Walnut Place Subdivision i RESOLUTION NO. 02-212 RESOLUTION DIVIDING A SPECIAL ASSESSMENT BETWEEN LOT 1 AND LOT 2 OF WALNUT PLACE SUBDIVISION WHEREAS,the Ames City Council has levied special assessment number 25819 for the Walnut Alley Paving Project, against a parcel consisting of Lots 7, 10, 11, 14 and 15, Block 8, Black's Second Addition to Ames, Iowa(former tax parcel#09-11-102-135); and, WHEREAS,the unpaid amount remaining on that assessment after the March 2002 payment totals $5,796.68; and, WHEREAS,that assessed parcel has been replatted into Lot 1 and Lot 2,Walnut Place Subdivision; and, WHEREAS,the County Treasurer through the City Assessor has requested that the City Council, using the authority granted in Section 384.61 Code of Iowa,divide the said special assessment between the aforesaid two lots of Walnut Place Subdivision; and, WHEREAS,the lien in favor of the City,arising under paragraph 5 of Section 364.65 Code of Iowa against the said real estate for the unpaid amount of the assessment shall not be affected by the proposed division; NOW,THEREFORE,IT IS HEREBY RESOLVED,by the City Council of the City of Ames, Iowa, as follows: 1. Special Assessment#25819 in the unpaid amount of$5,679.68 is hereby divided to the lots as follows: a) to Lot 1, Walnut Place Subdivision (tax parcel #09-11-102-125 the amount of $2,839.84. b) to Lot 2, Walnut Place Subdivision (tax parcel #09-11-102-145), the amount of $2,839.84. 2. The City Clerk is hereby authorized and directed to certify the aforesaid separate special assessments to the Treasurer of Story County, Iowa for collection over the remaining life of the original assessment in the same manner as though levied originally upon the two separate tracts of land. A copy of this resolution certified by the City Clerk as a true copy is to be filed with the Story County Recorder and the Story County Auditor, as well as the County Treasurer, to show this division of the assessment. PASSED and approved this 9th day of April , 2002.
