A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AMES,IOWA,
APPROVING THE APPLICATION OF BALL PLASTIC CONTAINER CORPORATION
FOR THE PURPOSE OF RECEIVING BENEFITS UNDER
2001 IOWA CODE SECTIONS 15.326-15.337 FOR IMPROVEMENTS
IN THE CITY OF AMES, STORY COUNTY,IOWA
WHEREAS, the City of Ames,Iowa,has received a request by Ball Plastic Container Corporation
to approve and submit an application to the State of Iowa under 2001 Iowa Code Sections 15.326-15.337,
the New Jobs and Income Program Act,hereafter referred to as the"Act"; and
WHEREAS, 2001 Iowa Code Sections 15.326-15.337,the New Jobs and Income Program Act
was established to promote economic development in the State of Iowa; and
WHEREAS,the City Council supports activities which promote and facilitate economic
development within the City; and
WHEREAS, one of the benefits provided under the Act is the commitment by a city to exempt
from taxation all or a portion of the actual value added by improvements to real property directly related to
new job creation by the location of an eligible business under the program with those new jobs being
directly involved in the operations of the eligible business at that location; and
WHEREAS, contingent upon approval by the Iowa Department of Economic Development,
Ball Plastic Container Corporation as an eligible business, and entry into an agreement with Iowa
Department of Economic Development pursuant to Iowa Code Section 15.332, the City of Ames will allow
for a ten(10)year schedule of exemption from taxation on the value added by the construction of a
manufacturing building as follows:
Year 1 80% Year 6 40%
Year 2 70% Year 7 30%
Year 3 60% Year 8 30%
Year 4 50% Year 9 20%
Year 5 40% Year 10 20%
of tax exemption on the value added by the construction of the manufacturing facility by Ball Plastic
Container Corporation; and
WHEREAS,Ball Plastic Container Corporation estimates that this project will involve an initial capital
investment of at least$19,700,000, to be made over the next five(5)years; and
WHEREAS, the City of Ames desires to declare the following site as an "economic development area"
subject to designation by the Iowa Department of Economic Development as an "economic development
area"pursuant to 2001 Iowa Code Section 15.327:
THE legal description for the Ball Plastic Container Corporation facility in Ames is:
Thies Subdivision of part of Lot 1,Spencer's First Industrial Addition to Ames,Story County,
Iowa as surveyed by John Conis in January, 1980 and filed in the office of the Story County

Recorder in Book 209,Page 309 and being more particularly described as follows:Beginning
at the Southwest Corner of Lot 2 of said Thies Subdivision;thence N74°58'21"E,90.11 feet
along the south line of said Thies Subdivision; thence N85°30'43"E, 720.97 feet to the
Southeast Corner of said Thies Subdivision and a point on the westerly right of way line of
U.S.Interstate#35;thence N00°27'20"W,620.06 feet along said line to the Northeast Corner
of said Thies Subdivision;thence S89°12'39"W,810.84 feet to the Northwest Corner of said
Thies Subdivision and a point on the easterly right of way line of Bell Avenue; thence
following said line S00°51'16"E, 150.60 feet; thence S00°4653"E, 119.22 feet; thence
S00°46'17"E, 80.06 feet; thence S00°50'21"E, 338.84 feet to the point of beginning,
containing 12.01 acres.
WHEREAS, Ball Plastic Container Corporation has indicated they will:
l. Provide coverage options where they will pay at least 80 percent of the health and dental insurance
plans for all full-time employees at the facility in which the new investments will occur.
2. Pay a median wage for 50 new production jobs(including all amounts paid on account of bonus,
commission, and overtime)of at least$11.96 per hour.
3. Create at least 50 new, full-time,non-management,production jobs for a period of not less than
five years.
4. Provide a profit sharing plan and a retirement/pension plan of the 401(K)-type to its full-time
employees.
5. Have a productivity and safety improvement program in place.
6. Have met plastics classification as a targeted industry.
WHEREAS, the City of Ames has determined that the Ball Plastic Container Corporation median
non-management production hourly wage rate of at least$11.96 has met the intent of Iowa Code Section
15.326-15.337 and all eligible benefits under those sections, and is reflective of 130 percent of the average
wage in Story County for new jobs.
NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of Ames,Iowa:
a. The City of Ames approves the expansion of Ball Plastic Container Corporation in Story County
for purposes of receiving the benefits of the Act authorizing the New Jobs and Income Program.
b. THE following described real estate is declared to be an economic development area:
Thies Subdivision of part of Lot 1,Spencer's First Industrial Addition to Ames,Story County,
Iowa as surveyed by John Conis in January, 1980 and filed in the office of the Story County
Recorder in Book 209,Page 309 and being more particularly described as follows:Beginning

C. Contingent upon approval by the Iowa Department of Economic Development of Ball Plastic
Container Corporation as an eligible business, and entry into an agreement with the Iowa
Department of Economic Development pursuant to Iowa Code Section 15.332,the City of Ames
will allow for a ten(10)year schedule of exemption from taxation on the value added by
improvements to the manufacturing building as follows:

d. The City Clerk shall provide a copy of this Resolution to the Iowa Department of Economic
Development and shall file a copy of this resolution with the Story County Assessor.
e. Officers of the City are hereby authorized to take such further actions as are deemed necessary in
order to carry into effect the provision of this resolution.
f. All Resolutions and parts thereof in conflict herewith are hereby repealed to the extent of such
conflict.
g. That the provisions of this Resolution are hereby declared to be separable and if any section,
phrase or provision shall for any reason be declared to be invalid, such declaration shall not affect
the validity of the remainder of the sections,phrases and provisions hereof
h. This Resolution shall become effective immediately upon its passage and approval.
