RESOLUTION TO APPROVE THE USE OF EMINENT DOMAIN
TO ACQUIRE EASEMENTS AND LAND TITLE AS NEEDED FOR
THE DAYTON AVENUE IMPROVEMENT PROJECT
WHEREAS, there is a reasonable expectation that the City of Ames will be able to achieve its
public purpose, comply with applicable standards,and obtain the necessary permits of the Dayton Avenue
Improvement Project; and,
WHEREAS every effort has been made and will continue to be made to acquire,
expeditiously by negotiation, the real property that is needed for that project; and,
WHEREAS before initiation of negotiations the amount of just compensation was determined in
accordance with Section 6B.54(2) Code of Iowa and Ames City Council Resolution No. 99-340; and,
WHEREAS,the City has made offers to acquire the needed property for the full amount determined
as aforesaid to be just compensation.
NOW,THEREFORE,BE IT RESOLVED,that the use of eminent domain proceedings shall be
commenced by the City Attorney with respect to those properties that have not been acquired through
negotiations, specifically:
