HomeMy WebLinkAbout~Master - Waiver of subdivision regulations for property at 2042 South 500th Avenue RESOLUTION NO. 02-094 RESOLUTION APPROVING MODIFIED REQUEST FOR WAIVER OF SUBDIVISION REGULATIONS PERTAINING TO PROPERTY LOCATED AT 2042 SOUTH 500TH AVENUE FOR THE CITY OF AMES, IOWA WHEREAS,the owners of the property located at 2042 South 500'Avenue propose to divide their 5.67 acres of land into two lots; and, WHEREAS,the proposed subdivision is located outside ofthe City's corporate limits in Washington Township, on the west boundary of Story County; and, WHEREAS, the property owners are requesting that the City Council waive the subdivision requirement to install infrastructure for a"Major Subdivision;"and, WHEREAS, the proposed subdivision is located in the Southwest Growth Priority Area, which is targeted for future residential growth; and, WHEREAS, extension of municipal water and sanitary sewer services to the proposed subdivision would present a"leap frog"pattern of development that would result in an inefficient extension of municipal infrastructure and services; and, WHEREAS, water main is planned for extension from the proposed water tower site to the future intersection of Mortensen Road and 500t'Avenue by November 2002; and, WHEREAS, in the immediate future, the City has no plans to extend sanitary sewer and water services to the proposed subdivision,however,because it is located in the Southwest Growth Priority Area, in the long term, it is planned that these services would be extended to the area in and surrounding the proposed subdivision; and, WHEREAS, staff believes that the property owners should be required to enter into an agreement with the City to provide an easement, at no cost, for the extension of public sanitary sewer infrastructure at the time when the City deems it necessary to provide such improvements; and, WHEREAS, staff believes it is necessary that the property owners waive their rights to object to future assessments for public improvements prior to the consideration of the Final Plat by the City Council. NOW, THEREFORE,BE IT RESOLVED by the City Council of the City of Ames,Iowa, that the request for waiver of the subdivision regulations pertaining to property located at 2042 South 500t'Avenue is approved subject to the following stipulations: 1. The property owners of the proposed subdivision must enter into an agreement with the City of Ames to provide an easement, at no cost, for the extension of public sanitary sewer infrastructure, in the proposed subdivision, at the time that the City deems it necessary to construct such improvements. The easement is to be placed on the entire property, at this time, and the location is to be further defined at the time that improvements are to be constructed. This agreement must be signed by the property owners prior to consideration of the Final Plat by the City Council. 2. The property owners must waive their rights to object to future assessments for public improvements, including, but not limited to, street paving, bicycle paths, sidewalks, and utility improvements,prior to consideration of the Final Plat by the City Council.
