RESOLUTION APPROVING RESTRICTIVE COVENANTS FOR
UNDERGROUND WELLS ON A PORTION OF
THE AMES MUNICIPAL AIRPORT
FOR THE CITY OF AMES, IOWA
WHEREAS, in 1989, the Iowa Department of Natural Resources (IDNR)began a program
to eliminate potential leaking underground fuel storage tanks; and,
WHEREAS, the Ames Municipal Airport began removing several old tanks in 1989 and
replaced them with two new fiberglass 10,000-gallon tanks in May 1992; and,
WHEREAS, since that time, the City has continued to monitor two contaminated soil sites
from the old tanks at the Airport, and throughout the years,the contamination has been reduced to
a level that monitoring is no longer required, and the sites now require no further action; and,
WHEREAS, in an effort to protect against any future contaminated water source,the IDNR
is requiring that the city ensure the public that no water well will be installed close to the previously-
contaminate site; and,
WHEREAS,the restricted area is an area within approximately one-quarter mile radius of the
old underground tank locations,and the City's water system provides potable water to this area;and,
WHEREAS,restrictive covenants have been prepared that will prohibit the establishment of
water wells in the area of the former contaminated sites, and they will provide the appropriate,
corrective action as required by the IDNR.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ames, Iowa,
that the restrictive covenants to prohibit the establishment of water wells on a portion of the Ames
Municipal Airport are hereby approved.
ADOPTED THIS 1 lth day of December, 2001.
