RESOLUTION APPROVING AND AUTHORIZING EXECUTION OF
AN AMENDED AND SUBSTITUTED CHAPTER 28E INTERGOVERNMENTAL
AGREEMENT RELATING TO THE URBAN DESIGN STANDARDS
FOR PUBLIC IMPROVEMENTS AND THE URBAN STANDARD
SPECIFICATIONS FOR PUBLIC IMPROVEMENTS
FOR THE CITY OF AMES,IOWA
WHEREAS, in February 1990, the Cities of Altoona, Ankeny, Bondurant, Carlisle, Clive,
Des Moines,Johnston,Norwalk,Pleasant Hill,Urbandale,West Des Moines,and Windsor Heights;
the Counties of Dallas and Polk,and the Des Moines Water Works and the West Des Moines Water
Works, all hereinafter referred to as the "ORIGINAL PARTICIPANTS," entered into a "28E
Agreement"to participate in the development of a Metropolitan Design Policy Standards Manual;
and,
WHEREAS,the City of Des Moines,Iowa,acting in the capacity of Administrator pursuant
to said 28E Agreement,entered into an Agreement for Professional Services with the firm of Snyder
&Associates of Ankeny,Iowa,hereinafter referred to as"Consultant,"dated February 26, 1990;and
did thereafter in the capacity of Administrator execute a Supplemental Agreement Number 1 with
the Consultant dated June 17,2001;a Supplemental Agreement Number 2 with the Consultant dated
January 4, 1992;a Supplemental Agreement Number 3 with the Consultant dated October 17, 1993;
a Supplemental Agreement Number 4 with the Consultant dated August 18, 1997; a Supplemental
Agreement Number 5 with the Consultant dated October 26, 1998; and a Supplemental Agreement
Number 6 with the Consulant dated June 5, 2000, all for the purpose of developing and updating
design standards and standard specifications for the construction of public improvements; and,
WHEREAS, acting pursuant to the aforesaid 28E Agreement, and working with the
Consultant pursuant to the aforesaid Agreement for Professional Services and Supplemental
Agreements thereto, the ORIGINAL PARTICIPANTS, acting through their Urban Standard
Specifications Committee,developed the Des Moines Metropolitan Design Standards Manual,which
was first promulgated by the Committee in 1993, and also developed the Urban Standard
Specifications for Public Improvements, which was first promulgated by the Committee in 1998;
and,
WHEREAS, in the fall of 1998, the ORIGINAL PARTICIPANTS amended said 28E
Agreement by Supplemental Intergovernmental Agreement to allow the Cities of Algona, Ames,
Boone, Creston, Fort Dodge, Grimes, Knoxville,Nevada,Newton, Pella,Perry, and Sioux City to
join with them as NEW PARTICIPANTS in the further development and continued updating of the
said Design Standards Manual and of the Urban Standard Specifications for Public Improvements,
and to allow the City of Des Moines, as Administrator, to thereafter execute Supplemental
Intergovernmental Agreements providing for the participation of ADDITIONAL NEW
PARTICIPANTS; and,
WHEREAS, since that time, the City of Des Moines has executed Supplemental
Intergovernmental Agreements with the Cities of Colfax, Cumming, Jefferson, Madrid,
Mitchellville, and Pleasantville allowing them to join, as ADDITIONAL NEW PARTICIPANTS,
with the ORIGINAL PARTICIPANTS and the NEW PARTICIPANTS in the further development
and updating of the Urban Design Standards for Public Improvements and of the Urban Standard
Specifications for Public Improvements; and,
WHEREAS, the ORIGINAL PARTICIPANTS, the NEW PARTICIPANTS, and the
ADDITIONAL NEW PARTICIPANTS (hereinafter referred to collectively as "the
PARTICIPANTS"), acting through the Urban Standard Specifications Committee,have continued
to fund the development and updating of the Urban Design Standards for Public Improvements and
of the Urban Standard Specifications for Public Improvements, and utilizing the services of the
organization's Consultant, Snyder and Associates,have developed and approved for use the Urban
Design Standards for Public Improvements, 2001 Edition (hereinafter referred to as "the Urban
Design Standards"),and the Urban Standard Specifications for Public Improvements, 1998 Edition,
as amended by Addenda Nos. 1 and 2 thereto (hereinafter referred to as "the Urban Standard
Specifications"); and,
WHEREAS, the PARTICIPANTS determined, in consultation with the Center for
Transportation Research and Education(hereinafter"CTRE")of Iowa State University(hereinafter
"University"), that it would be in the best interests of the PARTICIPANTS and of the other cities
and counties in the state of Iowa,if the Urban Design Standards and Urban Standard Specifications
were assigned to a statewide organization for continuing development and updating on a statewide
basis; and,
WHEREAS,CTRE proposed to coordinate and staff that effort on a statewide basis,provided
that the said Urban Design Standards and Urban Standard Specifications are licensed to them on an
interim basis pending the development of a statewide organization composed or representatives of
the Iowa Department of Transportation,the Metropolitan Planning Organizations(MPO),Regional
Planning Authorities(RPAs),Transportation Management Agencies(TMAs),regional associations
of local governments, and other appropriate constituencies throughout the state, which statewide
organization would act to provide policy guidance in the further development and updating of the
Urban Design Standards and Urban Standard Specifications and would be the entity owning said
documents in the future; and,
WHEREAS, CTRE has further proposed that the consultant contract with Snyder &
Associates for professional services in connection with the development, upgrading, and
promulgating of the Urban Design Standards and Urban Standard Specifications be assigned to
CTRE, and that CTRE take over the funding of said consultant contract and the development,
upgrading and promulgation of the Urban Design Standards and Urban Standard Specifications and
of the statewide design standards and standard specifications; and,
WHEREAS, Iowa State University, on behalf of CTRE, and the Iowa Department of
Transportation(hereinafter"Iowa DOT")have executed and entered into Addendum No. 89 to the
Agreement for management and Research Conducted by Iowa State University for the Iowa
Department of Transportation(hereinafter"Addendum No. 89"), copy of which is attached hereto
and made a part hereof and pursuant to which the Iowa DOT will fund the further development and
updating of the Urban Design Standards and Urban Standard Specifications and the development of
statewide design standards and standard specifications; and,
WHEREAS,representatives of the PARTICIPANTS have developed for consideration and
approval by their respective governing bodies an "Amended and Substituted Chapter 28E
Intergovernmental Agreement Amending All Prior Chapter 28E Agreements and Supplements
Thereto Relating to the Creation, Development and Updating of the Urban Design Standards for
Public Improvements and Urban Standard Specifications for Public Improvements,and Substituting
Therefor an Intergovernmental Agreement for the Purpose of (1) Creating the Central Iowa
Committee to Succeed the Urban Standard Specifications Committee; (2)Authorizing the Central
Iowa Committee to Temporarily License said Urban Design Standards and Urban Standard
Specifications to the Center for Transportation Research and Education (CTRE) and to the Iowa
Department of Transportation(Iowa DOT); (3)Authorizing the Central Iowa Committee to Assign
the said Urban Design Standards and Urban Standard Specifications to a Statewide Organization to
be Formed to Oversee the Continuing Development and Upgrading Thereof;and(4)authorizing the
City of Des Moines, as Administrator, to Assign to CTRE the Consultant Contract with Snyder&
Associates for the Provision of Professional Services" (hereinafter the"Amended and Substituted
Chapter 28E Intergovernmental Agreement"), to effectuate CTRE's proposal with respect to the
further development and updating of the Urban Design Standard and Urban Standard Specifications
and of the statewide design standards and standard specifications, as hereinabove described; and,
WHEREAS,this City Council has been advised and does believe that it would be in the best
interests of the City of Ames to approve and authorize execution of said Amended and Substituted
Chapter 28E Intergovernmental Agreement.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ames, Iowa,
that:
1. That the Amended and Substituted Chapter 28E Intergovernmental Agreement,copy
of which is now on file in the Office of the City Clerk and which by this reference is
made a part hereof, is hereby approved as to form and content.
2. That the Mayor and City Clerk are hereby authorized and directed to execute and
attest, respectively, said Amended and Substituted Chapter 28E Intergovernmental
Agreement for and on behalf of the City of Ames, Iowa.
