RESOLUTION NO. 01-066
RESOLUTION DIVIDING SPECIAL ASSESSMENT #25760 MADE
AGAINST OUTLOT Y OF DAYTON PARK SUBDIVISION, SECOND
ADDITION,AMONG THREE PARCELS NOW PLATTED AS LOTS 1 AND
2 AND OUTLOT Z OF DAYTON PARK SUBDIVISION, THIRD
ADDITION,AMES,IOWA
WHEREAS,the Ames City Council previously has levied special assessment number 25760 against Outlot Y,Dayton
Park Subdivision,Second Addition,Ames,Iowa;and,
WHEREAS,the unpaid balance remaining on the assessment as of this date,totals$13,254.00;and,
WHEREAS,the said Outlot Y of Dayton Park Subdivision, Second Addition has been platted into Lots 1 and 2 and
Outlot Z of Dayton Park Subdivision,Third Addition;and;
WHEREAS,a request has been made to the City Council to divide,using the authority granted in Section 384.61 Code
of Iowa,the unpaid balance of the said special assessment between the aforesaid Lots 1 and 2 and Outlot Z of Dayton
Park Subdivision,Third Addition,based on the area of each lot;and,
WHEREAS,the lien in favor of the City,arising under paragraph 5 of Section 364.65,Code of Iowa,against the said
real estate for the unpaid balance of the assessment will not be affected by the proposed division;
NOW,THEREFORE,IT IS HEREBY RESOLVED,by the City Council of the City of Ames,Iowa,as follows:
1. Special Assessment#25760 in the unpaid amount of$13,254.00 is hereby divided to the lots as follows:
a. Lot 1,Dayton Park Subdivision,Third Addition,Ames,Iowa $ 567.23
(1.765 acres)
b. Lot 2,Dayton Park Subdivision,Third Addition,Ames,Iowa $ 731.46
(2.276 acres)
C. Outlot Z,Dayton Park Subdivision,Third Addition,Ames,Ia $ 11,955.31
(37.2 acres)
2. The City Clerk is hereby authorized and directed to certify the aforesaid separate special assessments to
the Treasurer of Story County,Iowa,for collection over the remaining life of the original assessment in the same manner
as though levied originally upon the three separate tracts of land. A copy of this resolution certified by the City Clerk
as a true copy is to be filed with the Story County Recorder to show this division of the assessment.
