HomeMy WebLinkAbout~Master - Proposed Resolution of Necessity for Ferguson Subdivision Sanitary Sewer & Water RESOLUTION NO. 00-556 RESOLUTION TO ADOPT A PROPOSED RESOLUTION OF NECESSITY AND SET A DATE OF HEARING FOR THE FERGUSON SUBDIVISION SANITARY SEWER AND WATER MAIN PROJECT WHEREAS, this Council has adopted a preliminary resolution in accordance with Section 384.42 of the Code of Iowa, as amended covering Ferguson Subdivision Sanitary Sewer and Water Main Project (Hereinafter referred to as the "Improvement Project"); and WHEREAS, pursuant thereto, the Project Engineers have prepared preliminary plans and specifications, an estimated total cost of the work and a plat and schedule, including the valuation of each lot as determined by this Council, and the same have been duly adopted and are now on file with the Clerk; NOW, THEREFORE, Be it Resolved by the Council of Ames, Iowa, as follows: Section 1. That it is hereby found and determined to be necessary and in the best interest of the City and its inhabitants to proceed with the aforementioned Improvement Project, and to assess a portion of the cost thereof to the property benefited thereby. Section 2. That the Improvement Project shall constitute a single improvement and shall consist of the Paving Improvements more particularly described in the preliminary resolution relating to the Improvement Project previously adopted by this Council, which resolution is hereby referred to for a more complete description of the location and terminal points of the Improvement Project and the property benefited thereby and proposed to be assessed to pay a portion of the cost of such improvement. The location and terminal points of the Improvement Project are further described in the notice to property owners in Section 6 hereof. Section 3. That it is hereby found and determined that there are now on file in the office of the Clerk an estimated total cost of the proposed work and a preliminary plat and schedule showing the amount proposed to be assessed to each lot by reason of such Improvement Project. Section 4. That this Council will meet at 7:00 o'clock p.m., on the 23rd day of January, 2001, at the City Hall, 515 Clark Street, in the City, at which time and place it will hear the property owners subject to the proposed assessment or assessments and interested parties for or against the Improvement Project, its cost, the assessment thereof or the boundaries of the properties to be assessed. Unless a property owner files objections with the Clerk at the time of the hearing on the resolution of necessity, he or she shall be deemed to have waived all objections pertaining to the regularity of the proceedings and the legality of using the special assessment procedure. Section 5. That the Clerk is hereby authorized and directed to give notice as required by Section 384.50 of the Code of Iowa, as amended, by publication once each week for two consecutive weeks in a newspaper published at least once weekly and having general circulation in the City, and shall likewise mail a copy of such notice by certified mail to each property owner whose property is subject to assessment for the Improvement Project, as shown by the records in the office of the County Auditor not less than 15 days prior to the hearing on this resolution. The first publication of such notice in such newspaper shall be not less than 10 nor more than 20 days prior to the hearing. Section 6. That such notice shall be in form substantially, as follows: NOTICE IS HEREBY GIVEN: That there are now on file for public inspection in the office of the Clerk of Ames, Iowa, a proposed resolution of necessity, an estimate of cost and a plat and schedule showing the amounts proposed to be assessed against each lot and the valuation of each lot within a district approved by the City Council of Ames, Iowa, for a project, described in general as Ferguson Subdivision Sanitary Sewer and Water Main Project, of the type and in the location as follows: Terminal Points Water Main. Beginning at the NW corner of Lot 11 Ferguson Subdivision and running thence east 1517' along Dartmoor Road with 8" water main, and beginning at the south line of Lot 3 Ferguson Subdivision and running thence north along Dartmoor Drive 408' with 8" water main. Sanitary Sewer. Beginning at the sanitary sewer manhole approximately 404' NW of the intersection of Dartmoor Road and State Avenue and thence running South 26.16' West 416', thence South 47.82' West 313', thence South 43.25' West 254', thence South 47.22' West 379', thence South 85.590 West 289', thence North 14.880 West 403' and, beginning 59.6' SE of the SE property corner of Lot 4 Ferguson Subdivision and thence running North 310', thence West 347' thence North 150'. Kinds and Quantities of Materials and work 8" sanitary sewer, 15" sanitary sewer, manholes, and 8" water main, and appurtenances The Council will meet at 7:00 o'clock p.m., on the 23rd day of January, 2001, at the City Hall, 515 Clark, Ames, Iowa, at which time the owners of the property subject to assessment for the proposed improvement or any other person having an interest in the matter may appear and be heard for or against the making of the improvement, the boundaries of the district, the cost, the assessment against any lot or the final adoption of a resolution of necessity. A property owner will be deemed to have waived all objections unless at the time of hearing he has filed objections with the Clerk. According to the records of the County Auditor, you are the owner of: (Insert Legal Description) and the proposed assessment against the same is $ Diane R. Voss, City Clerk Section 7.
