HomeMy WebLinkAbout~Master - Agreement for Assessments for Improvements for Ferguson Subdivision RESOLUTION NO. 00-321 RESOLUTION APPROVING THE AGREEMENT FOR ASSESSMENTS FOR IMPROVEMENTS FOR FERGUSON SUBDIVISION FOR THE CITY OF AMES, IOWA WHEREAS, in October 1997, the property owners generally referred to as the "Ferguson Subdivision"petitioned the City for annexation; and, WHEREAS,on August 23, 1999,this Petition for Annexation was reviewed by the City Council and was tabled subject to the following: (1) receiving the results of the Annexation Study, (2)working out the details in the Annexation Agreement, (3)determining the benefits to the City to be derived from this annexation, and(4)identifying the initial costs to be borne by the City; and, WHEREAS, it has been determined that the initial capital improvement costs associated with the annexation of this property would be related to the extension of water and sanitary sewer infrastructure; and, WHEREAS, staff recommends the utilization of the City's Special Assessment Authority as a means to accomplish the installation of this infrastructure; and, WHEREAS, as a result of the Special Assessment approach staff has created an Assessment Agreement between the City and all participating property owners that indicates the responsibility for payment of the special assessments; and, WHEREAS, all parties included in the Petition for Annexation have agreed to the Assessment Agreement. NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of Ames, Iowa, that the Agreement of Assessments for Improvements pertaining to the Ferguson Subdivision is hereby approved.
