RESOLUTION APPROVING ASSIGNMENT OF
AGREEMENT WITH McLEODUSA NETWORK SERVICES,INC.,
AND McLEODUSA TELECOMMUNICATIONS SERVICES,INC.,
AND AMENDING AGREEMENT FOR INSTALLATION
OF FIBER OPTIC CABLE
FOR THE CITY OF AMES,IOWA
WHEREAS,in July 1996,the City Council approved an agreement with MWR Telecom to allow
MWR to place a limited amount of fiber optic cable on City poles and in the City right-of-way; and,
WHEREAS,McLeodUSA Network Services, Inc., is the successor by merger to MWR Telecom,
Inc., and it is necessary to execute an Assignment of Agreement; and,
WHEREAS,an Amendment Agreement for Installation of Fiber Optic Cable also is necessary due
to the approval of the new McLeodUSA pole rental agreement that occurred on March 28, 2000; and,
WHEREAS, as a condition for using the City's right-of-way and poles,MWR agreed to allow the
City to use eight pairs of fiber cable for its own purposes at a one-time cost of$2/lineal foot; and,
WHEREAS,since MWR had agreed to let the City use eight fiber pairs for a reduced fee,it would
not be appropriate to also charge McLeodUSA an additional $13.05/pole/year rental charge; and,
WHEREAS,this Amendment clarifies that McLeodUSA will not be required to pay that fee for the
limited number of poles utilized under the 1996 Agreement,however,the fee will apply to all future pole
attachments made by McLeodUSA.
NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of Ames,Iowa, that the
Assignment ofAgreement with McLeodUSA Network Services,Inc.andMcLeodUSA Telecommunications
Services,Inc.,and the Amendment to the Agreement for Installation of Fiber Optic Cable with McLeodUSA
are hereby approved.
ADOPTED THIS 1 lth day of April,2000.
