RESOLUTION ACCEPTING WARRANTY DEED
FOR THE EASTERLY 15' OF OUTLOT G
OF DAUNTLESS SUBDIVISION,4TH ADDITION,
FOR PURPOSES OF STREET RIGHT-OF-WAY
FOR THE CITY OF AMES,IOWA
WHEREAS,the final plat for Dauntless Subdivision,4th Addition, does not propose to dedicate
additional right-of-way for South Dakota Avenue; and,
WHEREAS,previously,the developer had dedicated 45'of right-of-way for South Dakota Avenue
as part of the approval of the final plat of the 1 st Addition to Dauntless Subdivision, which was also a
requirement of the Development Agreement between the City and the developer; and,
WHEREAS,since the approval of the Development Agreement,the City has changed the right-of-
way requirement in the subdivision regulations that is applicable to South Dakota Avenue; and,
WHEREAS, South Dakota Avenue serves as an arterial street that is intended for the movement
of traffic to and from many traffic generators,to serve as a route for traffic to travel between communities,
to accommodate a high degree of mobility, and to have a high degree of access control; and,
WHEREAS, as a result of this change in the regulations, an addition 15'of right-of-way adjacent
to proposed Outlot G is required; and,
WHEREAS, the owner of Outlot G, Jensen Development Corporation, LTD, is deeding the
required 15'of additional right-of-way to the City,and staff is recommending that the Warranty Deed for
purposes of street right-of-way be accepted.
NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of Ames,Iowa, that the
Warranty Deed for the easterly 15' of Outlot G of Dauntless Subdivision, 4th Addition, for purposes of
street right-of-way, is hereby accepted.
ADOPTED THIS 28th day of March, 2000.
