HomeMy WebLinkAbout~Master - Waiver of Jurisdiction for Pine Grove Subdivision RESOLUTION NO. 00-041 RESOLUTION WAIVING THE RIGHT TO REVIEW A TWO-LOT MINOR SUBDIVISION LOCATED NEAR THE LIMIT OF THE CITY'S TWO-MILE SUBDIVISION REVIEW JURISDICTION IN STORY COUNTY WHEREAS, in 1994, the City waived its authority to review the Pine Grove Estates Subdivision, a four-lot subdivision that was located at that time at the two-mile limit of the City's approval boundary; and, WHEREAS,now the owner of Lot 3 in the Pine Grove Estates Subdivision would like to split Lot 3 in order to transfer a portion of Lot 3 to the owners of Lot 4 for additional yard; and, WHEREAS, no additional residential lots will be created as a result of this split; and, WHEREAS,this additional yard area does include a small log cabin,however,the County will not allow the use of this cabin for residential purposes; and, WHEREAS,under Chapter 354.9 of the Iowa Code,the City may waive its authority to review subdivision plats within two miles of a city; and, WHEREAS, staff believes there is no need to review the proposed Minor Subdivision of Lot 3 in the Pine Grove Estates Subdivision since no additional residential lots will result from this replat and there will be no impact on the interests of the City by this division of land. NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of Ames,Iowa, that the waiver of the City's right to review a two-lot minor subdivision located near the limit of our two- mile subdivision review jurisdiction in Story County is hereby approved.
