HomeMy WebLinkAbout~Master - VisionAire Request to Sublease Buildings at Ames Municipal Airport RESOLUTION NO.00-008 RESOLUTION APPROVING REQUEST FROM VISIONAIRE TO SUBLEASE THEIR BUILDINGS AT THE AMES MUNICIPAL AIRPORT FOR A TWO-YEAR PERIOD WHEREAS,VisionAire's production schedule has again been revised,and it now appears that the company will not have a need for the full use of the Ames facility for up to 24 months;and, WHEREAS,it appears that,in order for VisionAire to maintain the facility in Ames,it is necessary for the company to have the ability to sublease the buildings to generate revenues to cover their costs. NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of Ames,Iowa, that the request from the VisionAire Corporation to sublet for two years(thru December 31,2001)the buildings they currently rent at the Airport is hereby approved with the following six stipulations: 1. Each and every sublease shall be compatible with Airport operations and the sublease shall be made on terms that vest in the City the power to cause the sublease to be terminated if the activities of the sublease are or become incompatible with the Airport operations. 2. Each and every sublease shall be consistent with city zoning,building codes,fire safety codes,electrical codes, plumbing codes,and any other applicable city,state,and federal regulations and shall vest the City with the power to cause the sublease to be terminated if the activities of the sublease on the subleased building premises are or become a violation of city zoning,building codes,fire safety codes,electrical codes,plumbing codes, or any other city,state,or federal regulations. 3. A decision by the City Manager or his designee to deny or withhold approval of a proposed sublease of the said buildings may be appealed for resolution by the City Council. 4. It is agreed that regardless of this delay in assembling aircraft at the plant as soon as first contemplated, VisionAire agrees not to request that the discounted rental rate of$100/acre on the land leased from the City be extended past the original five-year agreement. 5. Each and every sublease shall be made on terms that vest in the City the power to cause the sublease to be terminated if the FAA objects to the subleasing of said buildings at the Airport. 6. Each and every sublease should contain a provision that allows VisionAire to terminate the sublease with notice no greater than six months if the buildings are needed by VisionAire for their aircraft assembly operation.
