HomeMy WebLinkAbout~Master - Agreement with Union Pacific Railroad for Train Horns at Three Intersections RESOLUTION NO. 99-440 RESOLUTION APPROVING AGREEMENT WITH UNION PACIFIC RAILROAD FOR TRAIN HORNS AT DUFF, KELLOGG,AND CLARK AVENUES FOR THE CITY OF AMES,IOWA WHEREAS, Staff has been working for the past six months with the Union Pacific Railroad (UP) to facilitate an agreement to install additional automated train horns at the Clark Avenue, Kellogg Avenue, and Duff Avenue crossings; and, WHEREAS, this effort was slowed due to UP's concern that the automated train horn be redesigned and tested prior to issuing any agreements for further implementation of the system;and, WHEREAS, the automated horn agreement with the UP Railroad is the same as the one approved last year which specifies the operation of the automated train horns, the subsequent ban on horns,insurance requirements,installation procedures,indemnity clauses, and other items; and, WHEREAS,under this agreement,the Union Pacific Railroad will direct train engineers to refrain from sounding their train horns when the automated train horns are in operation, except for under conditions of immediate peril or to enhance and protect the public's safety, and, WHEREAS,both the UP and Staff believe that this year's program to install the train horns at the three crossings will improve compliance since the resulting "ban" would cover almost the entire city. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ames, Iowa, that the agreement with the Union Pacific Railroad to place automated horn devices at Clark Avenue, Kellogg Avenue, and Duff Avenue is hereby approved.
