RESOLUTION ACCEPTING DEED FROM FORBES PHARMACY CORPORATION
A/K/A MEDICAP PHARMACY TO STRIP OF LAND 8' WIDE ABUTTING
AND EAST OF THE EAST LINE OF LOT 1 OF LOCKWOOD'S ADDITION
FOR THE CITY OF AMES,IOWA
WHEREAS,the proposed site development of a Medicap Pharmacy at the northwest corner of Lincoln
Way and Duff Avenue was planned to be on two platted lots and an unplatted parcel of land 8'wide that abuts
Duff Avenue; and,
WHEREAS, at one time,the City had declared the 8'parcel of land as excess right-of-way and sold this
parcel to the abutting landowner; and,
WHEREAS,when Duff Avenue was widened at this location,the City purchased an easement over most
of the parcel for constructing a sidewalk; and,
WHEREAS,the new Subdivision Ordinance states that building permits may only be issued after property
has been properly platted; and,
WHEREAS,in order for the owner to comply with the Subdivision Ordinance,staff determined that they
would have to consolidate the 8'-wide strip of land with the other two lots and also dedicate T of additional right-
of-way for Lincoln Way through the major subdivision process; and,
WHEREAS, staff suggested that the owner would not have to complete the major subdivision process if
they would dedicate the 8'-wide parcel of land abutting Duff Avenue as right-of-way for Duff Avenue and also
dedicate the south 7'of the platted lots as right-of-way for Lincoln Way; and,
WHEREAS, Forbes Pharmacy Corporation chose to dedicate the subject parcels of land to be used as
rights-of-way and has executed a warranty deed to the City of Ames.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ames, Iowa, that the
warranty deed from Forbes Pharmacy Corporation to the City ofAmes for the 8'-wide parcel abutting Duff Avenue
and the south 7' of the two platted lots along Lincoln Way to be used as rights-of-way for Duff Avenue and
Lincoln Way,respectively, is hereby accepted.
ADOPTED THIS 14th day of September, 1999.
