HomeMy WebLinkAbout~Master - Creating Right-of-Way for access to proposed subdivision near Billy Sunday Road RESOLUTION NO. 99-270 RESOLUTION CREATING A RIGHT-OF-WAY TO PROVIDE ACCESS TO A PROPOSED SUBDIVISION NEAR BILLY SUNDAY ROAD FOR THE CITY OF AMES,IOWA WHEREAS, Jensen Design Build has requested that the City create a 66-foot right-of-way on land owned by the City for the purpose of providing access to property that the company has purchased; and, WHEREAS, the creation of the right-of-way will enable the property purchased to be subdivided into as many as five lots; and, WHEREAS, the land that is proposed to be created as public right-of-way is being used as a driveway to the Youth Sports Complex, the Ames Animal Control Shelter, and the former wastewater treatment plant; and, WHEREAS, in order for a subdivision to meet the City's requirements, all of the lots that are created must have access to a public street, and the street must meet design and improvement standards of the City; and, WHEREAS,staff has discussed with Jensen Design Build several options that could be used to pay for the cost of improving the area to be created as right-of-way, and special assessment financing is to be used to pay for the cost of improvements. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ames, Iowa, that the creation of a 66-foot right-of-way to provide public access to a proposed subdivision near Billy Sunday Road is hereby approved with the following conditions: that the right-of-way not be created until the Council takes action to approve the Final Plat of the proposed subdivision from Jensen Design Build; and,that Jensen Design Build sign a Waiver of Right to Appeal Assessments related to the special assessment financing for the street improvements.
