RESOLUTION NO. 99-148
RESOLUTION DIVIDING AMES SPECIAL ASSESSMENT
NO. 25639 MADE AGAINST THE NORTH 247' OF THE
SOUTH 280' OF THE EAST 965' OF THE WEST 1,545' ON
THE SW/4 OF SECTION 7, T83N R23W BETWEEN SIX
PARCELS NOW PLATTED AS OUTLOT X, LOT 3, LOT 4,
LOT 5, LOT 6, AND OUTLOT Y DAYTON PARK
SUBDIVISION, SECOND ADDITION,AMES,IOWA
WHEREAS, the Ames City Council previously has levied special assessment number 25639, by
Resolution No.96-292,for the Southeast 16th Street Paving project,against a parcel of property then
described as:
The north 247' of the south 280' of the east 965' of the west 1,545' of
the Swt/4 of Section 7, T83N R23W(10-07-351-000);
and,
WHEREAS,the said parcel has been platted into lots as part of Dayton Park Subdivision, Second
Addition, Ames, Iowa; and,
WHEREAS,the unpaid principal amount remaining on the said assessment after an October, 1998
payment is $68,275.90; and,
WHEREAS, a request has been made to the City Council to divide, using the authority granted in
Section 384.61, Code of Iowa, the unpaid balance of the said special assessment between six
specified lots based on the area of each lot; and,
WHEREAS,the lien in favor of the City,arising under paragraph 5 of Section 364.65 Code of Iowa
against the real estate for the unpaid balance of the assessment will not be affected by the proposed
division;
NOW,THEREFORE,IT IS HEREBY RESOLVED, by the City Council of the City of Ames,
Iowa, as follows:

1. Special Assessment#25639 in the unpaid principal amount of$68,275.90 is hereby
divided to the said lots as follows:
a) OUTLOT X $ 4,245.14
b) LOT 3 $ 11,321.07
c) LOT 4 $ 11,321.07
d) LOT 5 $ 12,266.32
e) LOT 6 $ 12,266.32
f) OUTLOT Y $ 16,855.98
2. The City Clerk is hereby authorized and directed to certify the aforesaid separate
special assessments to the Treasurer of Story County, Iowa, for collection over the remaining life
of the original assessment in the same manner as though levied originally upon the six separate tracts
of land. A copy of this resolution certified by the City Clerk as a true copy is to be filed with the
Story County Recorder to show this division of the assessment.
