RESOLUTION WAIVING LOT PRICE LIMIT UNDER RESEARCH PARK
PHASE II DEVELOPMENT AGREEMENT FOR RECOVERY OF ISU
TELECOMMUNICATIONS INFRASTRUCTURE COSTS
BE IT RESOLVED, by the City Council of the City of Ames, Iowa, that with respect to that
agreement between the City of Ames, Iowa and the Iowa State University Research Park Corporation
dated September 24, 1996, and recorded in the office of the Story County Recorder as Instrument
No. 97-08481 entitled: AGREEMENT FOR PUBLIC IMPROVEMENTS AND OTHER WORK
PERTAINING TO THE IOWA STATE UNIVERSITY RESEARCH PARK, PHASE Il, that part
of the said agreement designated as IV, LAND PRICES that sets a limit on the price per acre that
can be charged for lots is hereby waived, to that limited extent necessary to permit the Iowa State
University Research Park Corporation to charge an additional $7,424 per acre if the land purchaser
has declined to utilize the ISU telecommunications service, so as to enable the Iowa State University
Research Corporation to recover telecommunications infrastructure cost in accordance with the cost
recovery method stated in the January 1, 1999 letter from the Chair of the Iowa State University
Research Park Corporation Board of Directors to the Ames City Manager, a copy of which is
attached hereto, on the further condition that such additional amount per acre shall be transferred
immediately to the account of the ISU Telecommunications System.
