RESOLUTION TO ASSESS DEFICIENCIES PERTAINING
TO PARCEL 05-27-150-045 FOR THE BLOOMINGTON
ROAD PAVING PROJECT, AMES, IOWA
WHEREAS, at the time of the adoption of the Resolution of necessity for the
Bloomington Road Paving Project the special assessment that could be levied against
parcel 05-27-150-045 was insufficient to pay its proportion of the cost of the
improvement due to the unimproved condition of that lot at that time; and,
WHEREAS, subsequent to the said Resolution of Necessity and during the period for
which installments of assessments for the said project are made payable, a private
improvement has been constructed on said lot.
NOW, THEREFORE, BE IT RESOLVED by the City Council for the City of Ames, Iowa:
Section One. There shall be assessed hereby against said parcel 05-27-150-
045, consisting of land that is legally described as:
Beginning at a point 33' east and 33' north of the SW corner
of the NW'/. of Section 27 T84N R23W and running thence
north 357.62', thence east 466.69', thence south 357.62' to
the north right-of-way line of Bloomington Road, thence west
466.69' to the point of beginning. (05-27-150-045)
The said assessment deficiency in the amount of $8,653.42.
Section Two. The said assessment of deficiency shall be a pro rata portion of
the deficiency on that lot, in the same proportion to the total deficiency on that lot as the
number of future installments of special assessments remaining to be paid is to the
total number of future installments of assessments for the project, subject to the 25%
limitation of Section 384.62, Code of Iowa.
Section Three. This deficiency assessment shall be a lien on the said property
and is payable in the same manner, and subject to the same interest as the other
special assessments for the project.
Section Four. The City Clerk is hereby directed to certify this deficiency
assessment to the County Treasurer, and to send a notice of the deficiency
assessment by mail to each owner of the said land.
