HomeMy WebLinkAbout~Master - Correct Errors in Assessment for the City of Ames Freel Drive Sanitary Sewer Project RESOLUTION NO. 99-21 RESOLUTION TO CORRECT ERRORS IN ASSESSMENT FOR THE CITY OF AMES FREEL DRIVE SANITARY SEWER PROJECT WHEREAS, the City Council for the City of Ames has, pursuant to Section 384.60, Code of Iowa, adopted the final assessment schedule for the City of Ames Freel Drive Sanitary Sewer project by enactment of Resolution No. 98.425 on the 25th day of August, 1998; and WHEREAS, it is found that there is an error in the said assessment resulting in certain property being assessed too little in that assessment parcel No. 09-12-201-045 consisting of Lots 9, 10, and 11, Woodland Acres Plat 2, each of those lots having a frontage of 108.9 feet, was assessed as if it were only a single lot with a frontage of 108.9 feet, when in fact both Lots 10 and 11 of said parcel, with a combined frontage of 217.8 feet, benefit from the project and should be assessed, only Lot 9 of said parcel not being benefited because that lot received sanitary sewer service before the project, and, WHEREAS, it is found that there is an error in the said assessment resulting in certain property being assessed too much in that assessment parcel 09-12-200-090 consisting of Lot 9 Woodland Acres Plat 1 was assessed when it should not be assessed because that parcel was already receiving sanitary sewer service and received no benefit from the said project. NOW, THEREFORE, BE IT RESOLVED, by the City Council for the City of Ames, Iowa, pursuant to Sec. 384.74, Code of Iowa.. that: Section One. To correct the aforesaid errors, the attached final assessment plat and corrected schedule of assessments is adopted to replace and supersede the assessment schedule that was previously adopted, and a reassessment and relevy made in conformity with the correction. Section Two. Corrected assessments are a lien on the lots as if they were the original assessments. Section Three. The corrected assessments shall be certified by the City Clerk to the County Treasurer in the same manner as the original assessments. Section Four. In so far as practical the corrected assessments shall be collected in the same installments, draw interest at the same rate, and be enforced in the same manner as the original assessment.
