RESOLUTION ACCEPTING THE DEDICATION OF RIGHT-OF-WAY FOR 220 & 420
SOUTH TELLER AVENUE AND 5810 & 5898 EAST LINCOLN WAY
FOR THE CITY OF AMES, IOWA
WHEREAS, the approved plat of survey as described in Resolution No. 23-244 satisfies
all Subdivision Code requirements detailed in Section 23.308. Parcel `D' and Parcel `E' conforms
to the underlying zoning standards for lot requirements. Tract `1' and Tract`2' identifies the right-
of-way that will be dedicated to the City as necessitated as part of the Plat.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ames, Iowa,
that the dedication of Right-of-Way for 220 & 420 South Teller Avenue and 5810 & 5898 East
Lincoln Way is hereby approved.
ADOPTED THIS 25"' day of April, 2023.

RESOLUTION NO. 23-246
RESOLUTION APPROVING WAIVER OF FINANCIAL SECURITY WITH A
DEFERRAL OF SIDEWALK INSTALLATION FOR 220 & 420 SOUTH TELLER
AVENUE AND 5810 & 5898 EAST LINCOLN WAY
FOR THE CITY OF AMES, IOWA
WHEREAS,Chapter 22A sidewalk is required to be installed at the time of completion of
a building on a site,or in some limited cases the Public Works Director may allow for a temporary
deferral of up to three years or an in lieu contribution to a planned City project; and,
WHEREAS, Chapter 22A relates the sidewalk requirements to standards of Chapter 23
Subdivisions. If a subdivision approval determines a sidewalk configuration, then that is the
requirement for a site, rather than the default standard of one sidewalk on the north or east side of
an industrial site; and,
WHEREAS, staff believes that either on the east side of Teller or on the west side of Teller
a sidewalk or shared use path system will be extended at some point in the future. This would
allow for connection to the site as an extension on the east side of the development, or potentially
a crossing to the west side if an east side extension does not occur; and,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ames, Iowa,
that a waiver of financial security for sidewalk installation with a signed agreement for deferral
of sidewalk installation along the Teller Avenue frontage of Paracel D and Parcel E that identifies
a requirement for future installation of sidewalks upon notice by the City to install a sidewalk and
for the property owner to provide a minimum of a 10-foot wide easement for sidewalk installation
along the frontage of both parcels is hereby approved. The signed agreement and easement are to
be provided to the City prior to approval of a certificate of occupancy for a building on Parcel D
or Parcel E.
