HomeMy WebLinkAbout~Master - Relating to Tree Surgeons ■ ORDINANCE N0. $76 AN ORDINANCE PROVIDING FOR THE EXAMINATION AND LIC T�NSING OF THOSE OFFERING THEIR SER- VICES IN THE TRIMMING, YEMOVAL OR TREATMENT OF TREES. Be it ordained by the City Council of Ames, Iowa: SECTION 1 : Short Title . This ordiance shall be known as the "tree surgeon" ordinance. SECTION 2: Tree Surgeons Defined. The words "tree surgeon as used herein shall mean any person, firm or corporation, who solicits the work of felling trees, or who cuts or trims any tree or limbs or branches of any tree, or who offers services in the diagnosis and treatment of diseases of any tree, for a valuable consideration.. SECTION 3 : Annual License . Every tree surgeon shall annually, before engaging in any service designated in this ordinance, obtain a license from the City Clerk and shall pay an annual license fee of $5.00. The application for the license shall give inform- ation testing the applicant' s qualifications for this license and the nature of the equipment available. If the information on the application discloses a doubt as to the qualifications or equipment, the Clerk shall refer the application to the City Manager, who shall within 15 days report on the assertions in the application. All licenses shall terminate on December 31 of the year issued. SECTION 4: Insurance Required. Before any such license shall be issued, the applicant shall obtain and file with the City Clerk a public liability insurance policy, insuring against any loss that the City of e<i Ames, or any person may sustain arising out of or in connection with such services performed by such tree surgeon. Such insurance coverage shall include not less than j5, 000.00 property damage, $25,000.00 for a single personal injury or death,- and with limits of not less than "Y , 000.00 for multiple injuries or death. This coverage shall be in addition to automo- bile public liability insurance for any car or truck operated by the licensee in his business . Such policy shall obtain a provision that it may not be cancelled except after 30 days notice to the City Clerk. "'. SECTION 5: Penalties . Anyone violating any of the provisions of this ordinance shall, upon conviction, be fined not to exceed one hundred ( %100.00) dollars, or confined in ,jail for a term not exceeding y 30 days. s SECTION 6 : Repeal. All ordinances or parts of ord- inances in conflict herewith are hereby repealed. SECTION 7 : This ordinance shall be in full force and effect from and after its passage and publication as provided by law. Passed this lst day of October 1957.
